2. Definitions
Provider: Hypin Kft. (hereinafter "Provider", "we", "ReviewBooster").
Subscriber / User: a natural person aged 18 or older, sole trader, or legal entity who registers for ReviewBooster and enters into a subscription.
Consumer: a natural person acting outside their trade, business, craft or profession (within the meaning of Directive 2011/83/EU and Hungarian Civil Code § 8:1 (1) 3).
Business User: a Subscriber who is not a Consumer (company, sole trader, organisation).
End User: the Subscriber's customer who submits feedback through the ReviewBooster system.
Platform / Service: the ReviewBooster SaaS software available at reviewbooster.hu.
DPA: Data Processing Agreement under Article 28 GDPR (see §17).
3. Scope, acceptance and formation of contract
The Provider makes available a cloud-based (SaaS) platform enabling automated customer-review collection, feedback routing (positive reviews directed to Google, negative feedback handled privately), analytics and reputation management.
The contract is concluded electronically in English (or in the language of the selected locale) upon the User's registration and explicit acceptance of these Terms (checkbox). The contract does not qualify as a written contract but is stored electronically and remains accessible.
The Service is primarily intended for business use. Consumers may subscribe; where a Subscriber is a Consumer, the consumer-protection provisions in §§7 and 19 apply.
4. Account registration and security
- Registration requires accurate and up-to-date information.
- The User is responsible for keeping login credentials (email, password) confidential, and for all activity under their account.
- Upon suspicion of unauthorised access, the User must notify the Provider without delay at hello@reviewbooster.hu.
- A User may maintain only one active account (multi-location Subscribers may operate several profiles within a single account).
5. Acceptable Use Policy (AUP)
The User must use the Service only for lawful purposes, in accordance with applicable law and these Terms. The following are in particular prohibited:
- Fake, paid, misleading, non-genuine reviews, reviews written by persons who are not actual customers, or otherwise manipulated reviews ("fake review" production).
- Coercing, bribing or rewarding customers exclusively for positive reviews ("review gating" in a form that violates FTC / EU consumer-protection practice). The star-threshold split offered by the Service (4–5★ → Google, 1–3★ → private) is itself permitted; the User remains responsible for not restricting customers from expressing their genuine opinion.
- Spam, chain messages, unsolicited bulk communication.
- Defamation, harassment or reputation-damaging conduct towards third parties (competitors, individuals).
- Uploading or processing third-party personal data without a valid legal basis.
- Circumventing or probing the Platform's security mechanisms, unauthorised exploitation of vulnerabilities.
- Reselling, white-labelling or offering the Service as a sub-service to third parties without the Provider's written consent.
- Uploading unlawful, violent, hateful, sexually explicit or unauthorised content (logo, cover image, feedback).
- Breaching the terms of Google, Stripe, Resend, Supabase or other subprocessors through the Platform.
Breach of these rules entitles the Provider to suspend or terminate the account without prior notice (§§9–10), without refund of fees already paid.
6. Subscription plans, pricing, tax
6.1. Plans
The Provider offers three subscription tiers. Prices shown on the pricing page are in Hungarian forints (HUF) for HU customers and in euro (EUR) for EN/DE customers; the billing currency is determined at checkout. All prices are gross, including Hungarian VAT (27%) where applicable (see §6.5).
| Plan | Monthly | Annual (30% off) |
|---|---|---|
| Starter | €39/mo | €328/yr (€27/mo) |
| Boost | €78/mo | €655/yr (€55/mo) |
| Premium | €127/mo | €1,067/yr (€89/mo) |
Plan-specific features and limits are described on the current pricing page. The Provider may change fees going forward; already-started periods are not affected. Material fee changes are communicated 30 days in advance and give the User the right to terminate before the new fee takes effect.
6.2. Introductory discounts
Monthly subscribers receive 90% off the first month; annual billing includes a 30% discount applied to the full year.
The 90% first-month discount ends automatically with the next billing cycle and the subscription continues at the regular list price, unless the User cancels before renewal.
6.3. Auto-renewal
Subscriptions renew automatically at the end of each period (monthly → monthly, annual → annual), with the next fee charged automatically to the stored payment card. Auto-renewal can be disabled at any time in the dashboard or by emailing hello@reviewbooster.hu; the Service remains active until the end of the already-paid period and then expires.
6.4. Plan changes (upgrade / downgrade)
- Upgrade (higher plan): takes effect immediately. Stripe prorates the difference — the unused portion of the old plan is credited, and only the remainder of the new plan is charged. A corrective invoice is issued.
- Downgrade (lower plan): takes effect at the next renewal. The current, already-paid period continues on the old plan; no partial refund is given. Data affected by a downgrade (e.g. profiles above the new plan's limit) is the User's responsibility — exporting before the change is recommended.
- Monthly → annual: the annual discount applies immediately; Stripe prorates the difference.
- Annual → monthly: possible only at the end of the annual period; early switches do not entitle the User to a refund of the annual fee paid.
6.5. VAT, reverse charge, invoicing
- Hungarian customers: prices are gross, including 27% Hungarian VAT.
- VAT-registered businesses in other EU Member States: upon providing a valid VIES VAT ID, the reverse-charge mechanism (Art. 196 of Directive 2006/112/EC) applies; the invoice is issued without Hungarian VAT.
- Non-EU customers: no Hungarian VAT is charged on the Service.
- Invoice: for every payment a NAV-compliant electronic invoice is issued via Számlázz.hu (KBOSS.hu Kft.). The invoice is emailed to the Subscriber and remains downloadable in the dashboard.
- Payment: card payment (Visa, Mastercard, American Express) via Stripe. Card data is never stored by the Provider; Stripe is PCI DSS Level 1 certified.
7. Refund policy
Refunds are granted in the following cases:
- Consumer 14-day withdrawal: applies only to Subscribers who qualify as Consumers (natural persons subscribing in a private capacity). Pursuant to Directive 2011/83/EU (and Hungarian Government Decree 45/2014), the Consumer may withdraw from the contract within 14 days of its conclusion, without giving reasons. If the Consumer has expressly requested that performance begin during the withdrawal period, they lose the right of withdrawal upon commencement of the Service. Service commences when the User first meaningfully uses the Platform (creates a profile, generates a QR code, receives customer input).
- Business Users: the 14-day withdrawal right does not apply. Business Subscribers are governed by the ordinary cancellation rules (§9).
- Service downtime: if guaranteed 99.5% monthly uptime is not met (§8), the proportional amount is credited to the next invoice, or refunded in writing upon request.
- Incorrect charges: amounts charged in error or without authorisation are refunded within 7 business days.
No refund is provided:
- To Business Users for a period already commenced.
- To Consumers once the Service has started (except as above).
- For user errors during normal use (e.g. incorrect Google review link).
- Where the account is terminated due to AUP violation (§5).
Requesting a refund: email hello@reviewbooster.hu with invoice number, reason, and the last 4 digits of the payment card. Refunds are processed through Stripe to the original card, typically within 5–10 business days.
8. Provider obligations (SLA)
- Availability: 99.5% monthly uptime target, excluding scheduled maintenance and force majeure. Uptime is measured against the
/api/healthendpoint via monitored checks. - Scheduled maintenance: preferably between 02:00–06:00 CET, announced at least 48 hours in advance by email. Scheduled maintenance is excluded from the uptime calculation.
- Support: email-based, Monday–Friday 09:00–17:00 CET; first response within 8 business hours for critical incidents, within 2 business days otherwise.
- Backup: daily automated backups, retained for 30 days.
- Security: HTTPS (TLS 1.2+), database-level encryption, role-based access, 72-hour breach notification to Subscribers (§17.4).
9. Term, cancellation, expiry
The contract is concluded for an indefinite term, in monthly or annual billing periods, which automatically renew (see §6.3).
- Cancellation by the User: monthly plans may be cancelled at any time, effective at the end of the current period. Annual plans may be cancelled with effect at the end of the annual term. Cancellation is performed in the dashboard or via email to hello@reviewbooster.hu.
- Ordinary cancellation by the Provider: 30 days' notice by email, without cause. A pro-rata refund of any pre-paid, unused period is issued.
- Immediate termination: the Provider may terminate with immediate effect for material breach (AUP violation, non-payment beyond 14 days, fraud, court/regulatory order). No refund is issued in this case.
Effect of termination: the account is retained in an inactive state for 30 days (with export option), after which all Subscriber and End-User data is permanently deleted. Invoicing data is archived for 8 years under Hungarian accounting law.
10. Suspension
The Provider may suspend the Service in whole or in part in the following cases:
- Payment default exceeding 7 days, following a reminder.
- Reasonable suspicion of AUP violation (§5).
- Binding court or regulatory order.
- Security incident or conduct threatening system integrity.
During suspension the User may be unable to log in, and the public review page may become temporarily unavailable. The Provider notifies the User by email; the User may object within 14 days.
11. Intellectual property and licences
11.1. Provider's rights
The ReviewBooster platform, its source code, design, graphics, logo and the "ReviewBooster" brand are the exclusive property of Hypin Kft. The User receives a limited, non-exclusive, non-transferable, non-sublicensable right to use the Service for its intended purpose for the duration of the subscription.
11.2. User content licence
The User retains all rights in content uploaded to the Platform (logo, cover image, company info, custom text, End-User feedback). The User grants the Provider a limited, revocable, royalty-free, worldwide licence to store, process and display such content — solely for the purpose and duration of providing the Service.
11.3. Feedback licence
If the User submits ideas, feature requests, suggestions or other feedback to the Provider, the Provider may use such feedback free of charge and without restriction (including incorporating it into the Service), without owing compensation or attribution.
11.4. Reference use
The Provider may display the User's business name and logo as a reference on reviewbooster.hu and on its social-media channels without separate consent. The User may revoke this right at any time in writing to hello@reviewbooster.hu; the reference is removed within 14 days.
12. Third-party integrations
The Service relies on third-party providers (Google, Stripe, Supabase, Vercel, Resend, Számlázz.hu). Their outages, feature changes or term changes may affect the Platform. The Provider is not liable for third-party service interruptions or API changes, but will make reasonable efforts to restore or replace affected functionality.
Google (Google Reviews) applies its own rules; reviews posted there are outside the Provider's control.
13. Warranty disclaimer ("AS IS")
To the maximum extent permitted by law, the Service is provided "AS IS" and "AS AVAILABLE". The Provider does not warrant that:
- the Service will meet every User's specific needs;
- the Service will be uninterrupted or error-free;
- the User's review average, traffic or revenue will actually increase (figures shown in marketing are illustrative);
- any particular classification will be correct (e.g. star-threshold routing depends on the correctness of the Google link provided).
These disclaimers do not affect Consumer rights that cannot be excluded by agreement.
14. Limitation of liability
The Provider excludes liability for indirect, consequential, special, exemplary or punitive damages, including lost profits, data loss or business interruption, except where mandatorily prescribed by law (wilful misconduct, gross negligence, personal injury, Consumer statutory rights).
15. Indemnification
The User agrees to defend, indemnify and hold harmless the Provider, its directors, employees and subcontractors from and against any third-party claim, loss, damage or expense (including reasonable legal fees) arising out of:
- the User's breach of these Terms (in particular §5 — AUP);
- User content infringing third-party rights (copyright, trademark, personality rights);
- the User's unlawful or non-intended use of the Service;
- the User's failure to establish a proper legal basis for processing End-User data (§17.5).
16. Force majeure
Neither party is liable for delay or failure to perform caused by events beyond reasonable control (natural disaster, war, terrorism, cyberattack, state measures, power outage, major internet backbone outage, etc.). Payment obligations are also proportionally suspended if the Service is unavailable for more than 24 hours due to force majeure.
17. Data processing and subprocessors (DPA)
17.1. Processor role
Through the Service the User processes personal data (End-User names, emails, feedback) for which the User is the Controller under GDPR. The Provider processes such data on behalf of, and on the documented instructions of, the User, acting as Processor (Art. 28 GDPR). Acceptance of these Terms constitutes the written data-processing agreement required by Art. 28(3) GDPR.
17.2. Subject, purpose, duration, nature
- Subject: data submitted by End Users via the review form (optional name, optional email, star rating, free-text feedback, timestamp).
- Purpose: providing the Service (collection, routing, analytics).
- Nature: automated processing, editable and exportable via the admin dashboard.
- Duration: term of the subscription + 30 days after cancellation (export and deletion window).
- Data subjects: the User's customers (End Users).
17.3. Subprocessors
The Provider engages the following subprocessors. Each has a GDPR-compliant DPA in place. International transfers, where required, are protected by the EU Commission's Standard Contractual Clauses (SCC, Implementing Decision 2021/914) or the EU-US Data Privacy Framework (DPF).
| Provider | Purpose | Location / safeguard |
|---|---|---|
| Supabase Inc. | Database, authentication, file storage | EU (Frankfurt, eu-central-1) |
| Vercel Inc. | Application hosting, CDN | EU + global edge / SCC + DPF |
| Stripe Payments Europe Ltd. | Card payment processing | EU (Ireland) + USA / SCC + DPF |
| Resend, Inc. | Transactional and system emails | EU + USA / SCC + DPF |
| KBOSS.hu Kft. (Számlázz.hu) | Electronic invoicing, NAV-compliant online billing | Hungary |
The User gives general prior consent to the engagement of subprocessors. Any addition is announced at least 30 days in advance; the User may terminate within 30 days on those grounds.
17.4. Provider obligations as Processor
- Processes personal data only on the User's documented instructions (including international transfers).
- Ensures that personnel with access are bound by confidentiality.
- Implements the technical and organisational measures required by Art. 32 GDPR: encryption in transit (TLS 1.2+) and at rest (AES-256), role-based access, logging, regular backups, incident detection.
- Assists the User in fulfilling data-subject requests (Art. 28(3)(e)).
- Notifies the User without undue delay and at the latest within 72 hours of becoming aware of a personal data breach.
- Upon termination, returns or deletes personal data within 30 days, at the User's choice.
- Provides audit rights under Art. 28(3)(h): one scheduled audit per year on reasonable notice, accepting the Provider's annual compliance report and third-party certifications (e.g. Supabase SOC 2) as an alternative.
- The parties are jointly and severally liable towards data subjects under Art. 82 GDPR, with internal allocation based on fault.
17.5. Controller obligations
- Establishes a legal basis (consent, contract, legitimate interest) for processing End-User data.
- Informs End Users in its own privacy notice, referencing ReviewBooster as a processor.
- Does not upload special category data (Art. 9 GDPR) to the Platform.
- Forwards End-User rights requests (e.g. deletion) to the Provider without delay, or handles them through the dashboard.
18. Governing law, jurisdiction
These Terms are governed by the laws of Hungary, in particular: Act V of 2013 (Civil Code); Act CVIII of 2001 (E-Commerce Act); Act CXII of 2011 (Information Act); Regulation (EU) 2016/679 (GDPR); Government Decree 45/2014 on distance and off-premises contracts; Act C of 2000 (Accounting Act).
Jurisdiction: for Business Users, the parties stipulate the exclusive jurisdiction of the Budapest Tribunal (or, where subject-matter jurisdiction is lacking, the Pest Central District Court). For Consumers, the statutory jurisdiction rules apply (including the Consumer's right to sue at their own domicile under Art. 18 Regulation 1215/2012).
19. Consumer rights, ADR and ODR
A Subscriber qualifying as a Consumer has the following recourse options:
- Customer service: hello@reviewbooster.hu — response within 30 days.
- Alternative dispute resolution (HU): Budapest Conciliation Board (Budapesti Békéltető Testület), 1016 Budapest, Krisztina krt. 99, phone +36 (1) 488-2131, email bekelteto.testulet@bkik.hu, bekeltet.bkik.hu. EU Consumers may also contact the ADR body competent at their place of residence.

- Court: the Consumer may pursue claims before the court of the Provider's seat or at their own domicile.
20. Changes to the Terms
The Provider may amend these Terms unilaterally. Material changes (price increases, new obligations, changes to consumer rights) are announced at least 30 days in advance; non-material changes (typos, clarifications) are announced at least 15 days in advance by email. If the User disagrees, the User may terminate before the effective date. Continued use after the effective date constitutes acceptance.
21. Notices
- The Provider sends notices to the email registered on the account; the User must keep the address up to date.
- The User may send notices by email (hello@reviewbooster.hu) or by post to 1133 Budapest, Gogol utca 26., Hungary.
- Email notices are deemed delivered 24 hours after sending unless a bounce is received.
22. Miscellaneous
- Severability: if a provision is held invalid, the remaining provisions stay in effect; the invalid provision shall be replaced by a valid provision closest to the parties' original intent.
- Assignment: the User may assign rights and obligations only with the Provider's prior written consent. The Provider may assign the contract in the context of a corporate reorganisation, business-unit transfer or acquisition, upon 30 days' notice.
- No waiver: the Provider's failure to enforce a right is not a waiver of that right.
- Entire agreement: these Terms (together with the Privacy Policy) constitute the entire agreement and supersede prior agreements.
